Abstract
Adalet ve hakkaniyet anlayışı toplumların tarihteki gelişimleri ile birlikte insanlar arasında doğuştan bir eşitliğin var olduğu olgusunu doğurmuştur. Bu anlayış eşitlik olgusunun geliştirilmesine ve zamanla dünya devletlerinin bu olguyu benimseyerek eşitlik ilkesini hukuk sistemlerine entegre etmesine neden olmuştur. Ayrımcı yaklaşımlar zamanla toplumlar tarafından reddedilmiş, insanların dil, etnik köken, inandığı değerler, cinsiyet ve cinsel yönelim başta olmak üzere bir takım farklılıkları nedeniyle ayrı bir muameleye maruz kalmaları yasaklanmıştır. Bu çalışmanın ilk bölümünde, tüm insanların sadece insan olduğu için doğuştan sahip olduğu haklar bakımından uygulanacak ayrımcılık yasağının sağlanması ve eşitlik ilkesinin tarihsel gelişimi ile uluslararası hukukta korunması maksadıyla yapılan uluslararası hukuk kaynaklarındaki genel düzenlemelere ayrıntılı olarak yer verilmiştir. Ayrımcılığın engellenmesi maksadıyla, hukukumuzda da eşitlik ilkesi kapsamında Anayasal ve yasal düzenlemeler mevcuttur. Çalışmanın ikinci bölümünde mevzuat ve içtihatlar bazında, Türk iş hukukunda eşitlik ilkesinin normatif dayanaklarına değinilmiştir. Eşitlik ilkesinin iş hukukuna bir yansıması olarak işverenin eşit davranma borcunun ülkemiz hukukundaki yeri, yasal dayanakları, kapsamı, koşulları ve sınırları ile iş akdinin kurulması devamı ve akdin feshi süreçlerinde ilkenin uygulanış biçimleri değerlendirilmiştir. Son olarak, eşit davranma borcuna aykırılığın ispatlanması ve aykırılık halinde başvurulacak hukuki yollar ile uygulanacak hukuki, idari ve cezai yaptırımlar kapsamlı olarak incelenmiştir.
The understanding of justice and equity has led to the fact that there is an innate equality between people, together with the development of societies in history. This understanding has led to the development of the phenomenon of equality and, in time, the world states to adopt this phenomenon and integrate the principle of equality into their legal systems. Discriminatory approaches have been rejected by societies over time, and it has been forbidden for people to be subjected to separate treatment because of their differences in language, ethnicity, values, gender and sexual orientation. In the first part of this study, general regulations in international law resources, which were made in order to ensure the prohibition of discrimination to be applied in terms of the rights that all people are born with just because they are human, and to protect the principle of equality in historical development and international law, are given in detail. In order to prevent discrimination, there are constitutional and legal regulations within the scope of the principle of equality in our law. In the second part of the study, on the basis of legislation and case law, the normative bases of the principle of equality in Turkish labor law are mentioned. As a reflection of the principle of equality to the labor law, the place of the employer's obligation of equal treatment in our country, its legal bases, covering, conditions and limits and the application of the principle in the continuation of the establishment of the employment contract and the termination of the contract were evaluated. Finally, proving the violation of the obligation of equal treatment and the legal ways to be applied in case of violation and the legal, administrative and penal sanctions to be applied are examined in detail.
