Abstract
Kira sözleşmesi, kiraya verenin bir şeyin kullanılmasını veya kullanmayla birlikte ondan yararlanılmasını kiracıya bırakmayı, kiracının da buna karşılık kararlaştırılan kira bedelini ödemeyi üstlendiği sözleşmedir. Kira sözleşmesinde kiracının, en önemli borçlarından biri olan kira bedelini ödeme borcunu yerine getirmemesi, kanun koyucu tarafından bir takım sonuçlara bağlanmıştır. Bu çalışmada, kiracının kira bedelini ve yan giderleri ifa etmemesi sonucu temerrüde düşmesi ve buna bağlı hukuki sonuçlar değerlendirilmiştir. İlk olarak, kira sözleşmesine genel olarak değinilmiş, sonrasında kiracının temerrüdü, kira bedelinin ödenmemesine ilişkin özel durumlar, temerrüt faizi ve aşkın zarardan sorumluluk, sözleşmenin feshi ve tahliye konuları anlatılmıştır. Temerrüde bağlı olarak, kiralananın geri verilmesi hususu ve kiraya verenin hapis hakkı incelenmiştir.
The rental contract is a type of agreement which the lessor undertakes to leave the use of something or give the benefit of it together with usage and the lessee undertakes to pay the agreed rental price in return. The failure of the lessee to pay the rent, one of his most significant debts, was tied to some consequences by the legislator. In this study, the tenant's default as a result of not paying the rental price and side expenses and related legal consequences were evaluated. First of all, the lease agreement was mentioned in general, then the default of the tenant, special circumstances related to non-payment of the rent, default interest and liability for transcendental damages, termination of the contract and eviction issues were explained. Due to default, the issue of returning the tenant and the tenant's right to imprisonment was examined.
