Article Üçüncü Kişilere karşı Sorumlulukta Sigorta Hukukunun Rolü: Alman Hukukundaki Özel Sorumluluk Sigortası (Privathaftpflichtversicherung) (“PHV”) ile Türk Hukukundaki Üçüncü Kişilere karşı Mali Mesuliyet Sigortası (“ÜŞKMMS”) üzerinden bir Sigorta Bilinci Okuması(2025) Topcan, UtkuForeseeing risks and developing means of protection is not merely a quest for safety, but a reflection of a societal consciousness that pulses with the rhythm of civilization. Insurance is one of the key institutions through which this awareness materializes at both individual and collective levels. In Germany, the widespread presence of private liability insurance (Privathaftpflichtversicherung) (“PHV”) among citizens reflects not only an insurance product, but a collective attitude shaped by law, culture, and a sense of responsibility. In contrast, the near absence of interest in PHV’s Turkish counterpart, “third-party liability insurance” (“ÜŞKMMS”), on the part of citizens, market actors, and even the legal system points to underlying structural deficiencies. Inspired by a street interview published on a video-sharing platform, this study examines the legal foundations contributing to PHV’s widespread adoption in Germany, while also exploring why its equivalent remains marginal in Türkiye. Beyond comparison, this study calls for renewed attention to a silent corner of Turkish insurance law-an area that demands both legal and cultural reflection. At the intersection of legal regulation and individual responsibility, what is at stake is more than just a type of insurance; it is a broader expression of social and legal consciousness.
