Article Yeni Türk Sermaye Piyasası Kanunu Uyarınca Sermaye Piyasalarında Denetleme ve Tedbirler(2015) Karademir, Ebru; Kubilay, Huriye; Chellı, Ebru AyDenetleme fonksiyonu, Sermaye Piyasası Kurulu’nun düzenleme fonksiyonundan sonra en önemli fonksiyonlarından birisidir. Sermaye piyasalarının etkili bir biçimde çalışması için Kurul’un denetleme gücü caydırıcı tedbirler ve yaptırımlarla desteklenmelidir. Makalemizin ana konusu, 6362 sayılı ve 6 Aralık 2012 tarihinde kabul edilen ve 30 Aralık 2012 tarihinde 28513 sayılı Resmi Gazete’de yayımlanan Türk Sermaye Piyasası Kanunu’daki denetleme ve tedbirlere ilişkin hükümlerin incelenmesidir. Makalede bunun yanında Avrupa Finans Denetleme Sistemi’ne ve Sermaye Piyasası Kanunu’nun denetlemeye ilişkin hükümlerinin temelini oluşturan Türk Anayasası’nın ilgili maddesine de değinilmiştir. Türk sermaye piyasalarının denetlenmesinden sorumlu olan Kurul’un yanında, makalede ayrıca bağımsız diğer kuruluşlar da düzenleme ve denetleme görevleri çerçevesinde kısaca incelenmiştir.Article Ortaklık Hukuku Kapsamında Avrupa Birliği ve Türk Vatandaşlarının Çalışma ve Oturma Hakları(2025) Akduman, EbruAvrupa Birliği (AB)’ne üye bir ülkede çalışmak isteyen üçüncü ülke vatandaşları ev sahibi ülkenin göç ve istihdam politikasının gereklerini yerine getirmek zorundadır. Diğer taraftan, çalışmamızda tartıştığımız üzere AB-Türkiye ortaklık hukuku Türk vatandaşlarının AB’de çalışması ve AB vatandaşlarının Türkiye’de çalışması hakkında karşılıklı hak ve imkanlar sunmaktadır. Ortaklık hukuku; Ankara Anlaşması, Katma Protokol ve Ortaklık Konseyi kararlarını içermektedir. Prensip olarak, ortaklık hukukunun lehe hükümleri milli hukuklara öncelikli olarak uygulanmaktadır. Ancak, 1/80 sayılı Ortaklık Konseyi Kararı sadece bir Üye Ülkede yasal olarak çalışmakta olan Türk vatandaşları ile ailelerine uygulanmaktadır. Diğer deyişle, Karar çalışma izinlerini değil çalışma izinlerinin uzatılması halini düzenlemektedir. Ortaklık hukuku, Türk vatandaşlarına serbestçe bir üye devlete yerleşme olanağı sunmamakla beraber Türk göçmen işçilere ve ailelerine birçok üçüncü dünya ülkesine kıyasla avantaj sağlamaktadır. Mevcut durumun korunması (standstill) ilkesi ise sadece işçilere değil serbest çalışanlara da koruma sağlamaktadır. Buna göre, ortaklık hukukunun yürürlüğe girmesinden sonra bir Üye Ülke, ilgili mevzuatını sadece Türk vatandaşlarının lehine olarak değiştirebilmektedir.Article Evrensellik İlkesi Üzerine Bir İnceleme: Suçların Sınıflandırılması ve Uluslararası Adli İşbirliği İhtiyacının Rolü(2023) Sayar Kanyış, Tansu; Kanyış, Tansu SayarEvrensellik ilkesi, yargılamayı yapacak devlet ile işlenen suç arasında bağlantı noktası aranmaksızın uluslararası ceza yargısı yetkisi sağlar ve istisnai niteliklidir. İlkenin bu istisnai niteliği, ilkeye tabi suçların sınırlı sayıda olmasını gerektirir. Söz konusu suçların nitelikleri belirlenmelidir. İlkeye tabi suçların doğası, ilkenin tanımlanma, düzenlenme ve uygulanma biçimlerini şekillendirmektedir. Söz konusu suçlardan bir kısmı jus cogens normu ihlali oluşturduğundan bu kapsamdayken diğer kısmı uluslararası organize suçlardır. Jus cogens normu ihlali oluşturan suçların aksine, uluslararası organize suçlara devletin müdahil olduğunu ispatlamak zordur. Uluslararası organize suçların nitelikleri gereği bir devletin tek başına bu suçlarla mücadele etmesi oldukça güçtür ve devleti bu suçları yargılamaya muktedir değilmiş gibi gösterir. Bu nedenle bu tip suçlar için uluslararası işbirliği, devletin müdahil olmasına alternatif bir unsur olarak kabul edilmelidir. Öyleyse evrensellik ilkesine tabi suçlar, “jus cogens normu ihlali oluşturan uluslararası suçlar”-“diğer uluslararası suçlar” şeklinde ikiye ayırarak incelenmelidir. “Jus cogens normu ihlali oluşturan uluslararası suçlar”, “doğrudan evrensellik ilkesine” tabidir. Evrensellik ilkesinin bu uygulanma biçimi, her devlete yargılama yükümlülüğü yükler. “Diğer uluslararası suçlar” ise evrensellik ilkesinin “dolaylı evrensellik ilkesi” şeklinde düzenlenip uygulanmasını sağlar. Yüklediği ya iade et ya yargıla yükümlülüğü sayesinde, faili elinde bulunduran devlet, faili ancak suçun işlendiği yer devletine iade edemiyorsa yargılama yükümlülüğü altındadır ve yargılama yetkisi ikincil niteliktedir.Article Transforming the Judiciary Into the Rulers’ Proxies: the Case of Hagia Sophia(2022-12-18) Bahçeci, Barış; Yolcu, SerkanThis article examines from a critical perspective the judgment of the Turkish Council of State (Danıştay) in 2020, which invalidated the executive decision of 1934 regarding the designation of Hagia Sophia in Istanbul as a museum. We argue that Council of State did not really perform adjudication of a legal dispute in this case, but rather functioned as a proxy of the executive power for particular reasons. As a matter of fact, we argue the justifications regarding the case law of the European Court of Human Rights (ECtHR) and the right to property on which the decision was based to be a falsification. Moreover, the developments before and after the decision demonstrate this judgement to be a product of a non-judicial motivation. Lastly, the sequence of political actions regarding the conversion of several other museums into mosques that have been observed in Turkey over the last ten years implies the non-judicial dynamics behind the Council of State’s decision regarding Hagia Sophia. Our analysis reveals the political decisions that would possibly be the subject of criticism by domestic opponents and the international community to have been eliminated by referring the issue to the packed courts in order to avoid all undesired consequences.Article Cjeu and Ecthr: Two Sides of the Same Coin or Different Currencies ?(2017) Bulak Uygun, Begüm; Uygun, Begüm BulakThe protection of fundamental human rights across Europe reminds the issue of the European Union (EU) accession to the European Convention on Human Rights (ECHR). The analysis of the interaction between the Court of Justice of the European Union (CJEU) and the European Court of Human Rights (ECtHR) is essential for a better understanding of the multi-layered human rights architecture in Europe.With reference to multi-level components, this study focus on the following issues in order to find out whether the CJEU and ECtHR consist two sides of the same coin - meaning that they adjudicate human rights in the same way - or if they constitute different currencies – meaning that they have different impacts in human rights protection. An overall appraisal of the cohabitation of these two judicial powerhouses will be made by reference to the state of human rights protection within the regional mechanisms and their impact at national level.Article Databases and Criminal Procedures in Switzerland and Turkey With Regard To European Council’s Standards(2017) Bulak Uygun, Begüm; Uygun, Begüm BulakDatabases are increasingly used by law enforcement to effectively investigate and prosecute criminal offences. The growing tendency and need for law enforcement to use big data is particularly challenging when the data is stored abroad. As law enforcement authorities’ coercive powers are limited to their national territories, the path to enhanced judicial cooperation in criminal matters and police cooperation is of paramount importance. With the increasing use of big data, personal data processing takes place when the concerned individuals whose data is actually being processed are absent. This raises issues related to data regulations and to the effectiveness of existing mechanisms of legal protection for data subjects. This article deals with concerns relating to privacy protection in the context of data retention and judicial data exchange in Europe. To this end, a comparative analysis of Swiss and Turkish legal frameworks with regard to the European Court of Human Right’s case law provides a useful tool in identifying the legal standards that can help strike a fair balance between legitimate interests in database use and personal privacy protection. The specifics of the interplay between the right to privacy and the prevention and combatting of crime in Swiss and Turkish cultures also creates a fertile ground to discuss the flaws in existing regulations.Article Direct Democracy and Judicial Review: a Comparative Study of Us and Swiss Legal Systems(2018) Bulak Uygun, Begüm; Uygun, Begüm BulakIn the US, almost half of the states haveestablished direct democracy mechanisms, but thereis a paucity of such mechanisms at the federal level.By contrast, the Swiss system knows extensive directdemocracy at both the cantonal and the federal level,including rights of referendum on laws enacted by theparliament and popular initiatives for constitutionalrevision.This paper focuses on how direct democracymechanisms, such as referendums and citizens’initiatives serving an overarching ideal of publicsovereignty, may inform and affect judicial review. Thepaper also examines certain differences in treatmentbetween federal and state laws when it comes tojudicial review, as the courts will not necessarily applythe same standards despite the existence of similardemocratic mechanisms at both levels.In this contribution, I first argue that none of theexisting systems is fully satisfactory. The status quo inthe Swiss model might be a source of instability andthreaten legal certainty, coherence and transparencyand could ultimately be more harmful to publicsovereignty in that federal acts may in practice be setaside without constitutional basis. As to the US model,the combination of an absence of citizen involvementat the federal level with extensive judicial reviewmight ultimately be deemed as unsatisfactory fromthe perspective of democratic rights.This does not mean however that directdemocracy is somehow superior to representative,or that either of judicial or legislative power shouldprevail over the other. To the contrary, in this paper Iargue that in a federal system all are complementary.Furthermore, I claim that one should recognise thelimits of direct democracy and of judicial review inorder to improve both by striking a balance betweenthem.Article Citation - WoS: 2Citation - Scopus: 3Legal Awareness of Elderly About Abuse and Neglect(Gunes Kitabevi Ltd Sti, 2016) Sisli, Zeynep; Kizil, Melahat; Ustunkarli, Nursun; Şemin, Makbule İlgiIntroduction: The weakness and dependence of elders may expose them to abuse and neglect more than other age groups. This research aimed to evaluate legal awareness of elderly about which behaviors of abuse and neglect could be considered as criminal. Materials and Method: A questionnaire was administered during face-to-face interviews to 74 elderly people (>65 years of age) in a nursing home in Izmir. The statistical analysis of data was evaluated by SPSS 21. Results: Majority of the participants demonstrated legal awareness regarding physical and psychological behaviors that could be considered criminal, whereas many were unaware that these behaviors could be considered criminal even when the perpetrator acts unintentionally. Most of the participants were aware of increased penalties in cases where abuse or neglect is committed against those unable to defend themselves because of age; and for cases of torment. However it is also seen that many of them did not apply to legal ways when they experienced that type of behaviors. Conclusion: It is important to increase awareness regarding the criminal nature of abuse and neglect against elderly and to establish effective and easily accessible legal assistance.Article Citation - Scopus: 2Protecting Older Workers' Health in Legal Terms Comparatively European Eacquis in the Light of Ilo R162(Gunes Kitabevi Ltd Sti, 2020-09-30) Sisli, ZeynepIntroduction: This article discusses the specific laws, regulations, and recommendations aimed at protecting older workers against occupational accidents and illnesses and whether they are properly regulated by Turkish legislation compared with the European Union acquis, in order to protect older workers against discrimination, and to make their working conditions more appropriate for their ages, in the light of International Labour Organization Recommendation No. 162. Materials and methods: This conceptual article was prepared by evaluating the legal framework for protection of the occupational health and safety of older Turkish workers, through a comparison of Turkish law, International Labour Organization Recommendation No. 162, and the European Union acquis, and consideration of the facts reported in the relevant literature, using the document analysis method. Results and Conclusion: Neither Turkish labour law nor European Union acquis include sufficient regulation to protect the health and safety of older workers at work. Older workers' health should be protected specifically by social law, without driving them to poverty. Changes in the regulation of working conditions that would be supported by the social security system have been proposed to protect the health of older workers as a specially protected group.
