Hekimin Tıbbi Uygulama Hatalarından Doğan Hukuki Sorumluluğu

Abstract

Çalışmamızın konusu hekimin tıbbi uygulama hatalarından doğan hukuki sorumluluğudur. Hazırlanmış olan çalışmamız giriş ve sonuç bölümleriyle birlikte beş bölümden oluşmaktadır. Giriş bölümünde çalışmamızın yazılış amacı ve konusu temel düzeyde anlatılmış olmakla birlikte, sonraki bölümlerde bahsedilecek olan konu başlıkları detaylandırılarak aktarılmıştır.Birinci bölümde tıbbi müdahale kavramı ve konuya ilişkin temel kavramlar açıklanmış olup; bununla birlikte hasta ile hekim arasındaki hukuki ilişkinin mahiyeti hususuna değinilmiştir.İkinci bölümde tıbbi uygulama hatası (malpraktis) ve komplikasyon kavramları kendi içlerinde özelleştirilerek incelenmiş ve bu iki kavram arasındaki ayrım açıklanmıştır.Çalışmamızın üçüncü bölümünde hekimin tıbbi uygulama hatasından doğan hukuki sorumluluğu ve hekimin tıbbi uygulama hatasına karşı alabileceği hukuki önlemler incelenmiştir.Çalışmamızın son bölümünde yapılmış olan araştırmalar sonucu ulaşılan bilgiler ışığında hekimin tıbbi uygulama hatasından doğan hukuki sorumluluğuna ilişkin genel bir değerlendirme yapılmıştır.İncelenmekte olan konu pek çok detaylı alt başlığa sahip olduğundan çalışmamızda konu sınırlandırılmasına gidilmiştir. Bu sebeple çalışmamızda hekimin özel hukuk sorumluluğu temel alınmıştır.Çalışmamızda hekimin idari, cezai ve disiplin sorumluluğu incelenmemiştir.

The subject of our study is the legal responsibility of physician arising from medical malpractice. Our prepared work consists of five parts with the entrance and conclusion section.Although the purpose and subject of our work in the introduction section is explained at the basic level, the topics to be mentioned in the following sections are detailed and conveyed.In the first section, the concept of medical malpractice and the basic concepts related to the subject are explained;however, the nature of the legal relationship between the patient and the physician has been mentioned.In the second section, the concepts of medical malpractice and complication were examined by privatization within themselves and the distinction between these two concepts is explained.In the third section, the legal responsibility of the physician within the scope of medical malpractice and the methods of protection from medical malpractice were examined.In light of the information obtained as a result of the researches carried out in the final part of our study, a general assessment was made regarding the legal responsibility of the physician arising from the medical malpractice.Since the subject being examined has many detailed sub-headings, the subject was limited in our study. For that reason, the private law responsibility of the physician was taken as basis in our study. In our study, the administrative, criminal and disciplinary responsibility of the physician was not examined.
