Çalışanların Kişisel Verilerinin İş İlişkisi Kapsamında Korunması

Abstract

Günümüzde ticari, kamusal ve sosyal hayatta, bizi biz yapan kişisel verilerin toplanması ve çeşitli amaçlarla işlenmesi kaçınılmaz hale gelmiştir. Bireylerin mahremiyet ihtiyacından doğan kişisel verilerin korunması hukuku; bu kaçınılmaz durumu engellenmese bile gerçekleştirilen kişisel veri toplama ve işleme faaliyetlerinin en aza indirilmesini ve toplanan verilerin depolandığı ortamlara yetkisiz kişiler tarafından erişiminin önüne geçilmesini amaçlamaktadır. Bu bağlamda bu çalışmada kişisel verilerin korunması hukukunun gelişimine ve başlıca uluslararası dayanaklarına ve bunların Türkiye'nin ulusal mevzuatına etkilerine, çalışma hayatında da istihdam edenler tarafından çalışanların sahip olduğu kişisel verilerin birçok farklı nedenle ve araçla toplanarak işlenmesi nedeniyle öncelikle yer verilmiştir. Ayrıca çalışma hayatının emek gücünü oluşturan çalışanlar geniş kapsamda ele alınmış, henüz bir iş ilişkisi içinde bulunmayan ancak çalışma hayatına dahil olan aday işçilerin, iş sözleşmesi kapsamında çalışan işçilerin, işçi benzeri stajyer ve çırakların, atama yoluyla kamu kurumlarında çalışan devlet memurlarının sahip olduğu kişisel veriler incelenmiştir. İstihdam edenlerin mevzuattan kaynaklanan yükümlülüklerini yerine getirirken işlediği çalışanlara ait kişisel verilerin yanında çalışma ortamından ve işin yürütülmesinden kaynaklanan nedenlerle işlenen kişisel verilere de değinilmiştir. Kişisel verilerin korunması hukukunun Türkiye'de içtihatlarla gelişen bir alan olduğu göz önüne alınarak, Anayasa Mahkemesi ve Avrupa İnsan Hakları Mahkemesi kararları ile Kişisel Verileri Koruma Kurulu'nun verdiği kararlar incelenmiş, yurtdışında bulunan veri koruma otoritelerinin görüş ve önerilerine yer verilmiştir.

Today, it has become inevitable to collect personal data and process it for various purposes in commercial, public and social life. Law on the protection of personal data arising from the need for privacy of individuals; Even if it doesn't totally prevent inevitable situations, it aims to minimize personal data collection and processing activities and to prevent unauthorized access to the environments where the collected data is stored. In this context, the development of personal data protection law and its main international bases and their effects on Turkey's national legislation are included in this study. Because personal data owned by the employees are collected and processed for many different reasons and by means of those who employ them in their working life. In this study, the employees who make up the labor force of working life are discussed in a wide scope, the personal status of the candidate workers who are not yet in a working relationship but are included in the working life, workers working under the employment contract, interns and apprentices like workers, and civil servants working in public institutions by assignment data were analyzed. In addition to the personal data of the employees processed by the employers while fulfilling their obligations arising from the legislation, the personal data processed for reasons arising from the working environment and the conduct of the business are also mentioned. Considering that the law on the protection of personal data is an area that has developed with case law in Turkey, the decisions of the Constitutional Court and the European Court of Human Rights and the decisions of the Personal Data Protection Board have been examined, and the opinions and suggestions of the data protection authorities abroad are given.
