Abstract
Bu çalışmada, Türk Ceza Muhakemesi hukukunda arama ve elkoyma koruma tedbirleri bakımından delil yasakları konusu incelenmiştir. Ceza Muhakemesi Hukukunun amacı maddi gerçeğe ulaşmaktır. Gerçeğe ulaşılırken, her ne pahasına olursa olsun anlayışıyla, kişi bir soruşturma objesine dönüştürülmemelidir. Ceza muhakemesinin yürüyüşünde delil elde etmede başvurulan arama ve elkoyma tedbirleri kişi hak ve özgürlüklerini doğrudan ilgilendirmektedir. Koruma tedbirlerinin uygulanması esnasında insan onurunu zedeleyen her türlü bedensel ve ruhsal müdahaleleri tüm ulusal ve uluslararası hukuk metinleri suç saymıştır. Ceza Muhakemesi Hukukumuzda 'delil serbestisi' ilkesi geçerlidir. Bu ilke gereği maddi gerçeğin her türlü ispat araçlarıyla ortaya konulabilmesi imkanı öngörülmüş olsa da soruşturma ve kovuşturma makamlarına delillerin toplanması sürecinde sınırsız bir yetki ve keyfiyet tanınmamıştır. Adli makamlar arama ve elkoyma tedbirlerine başvururken Anayasa ve Kanunda öngörülen hukuka uygun yol ve yöntemlerle delil elde etme usullerine mutlak şekilde riayet etmelidir. Bu sınırların korunması ile ancak özgür ve güvenli bir hukuk devleti yaratılabilir. Bu kapsamda çalışmamızda hukuk devleti esaslarına uygun bir ceza muhakemesinde arama ve elkoyma tedbirlerindeki delil yasakları AİHM, Anayasa, CMK ve ilgili diğer kanun ve yönetmelikler dikkate alınarak değerlendirilmiştir.
In this study, the issue of evidence prohibitions in terms of search and seizure protective measures in Turkish Criminal Procedure Law has been examined. The aim of Criminal Procedure Law is to reach the material truth. While reaching the truth, the person should not be turned into an object of investigation with the understanding of no matter what. Search and seizure measures applied in obtaining evidence in the course of criminal procedure directly concern individual rights and freedoms. All national and international legal texts have considered any physical and mental interventions that harm human dignity during the implementation of protective measures as crimes. The principle of 'freedom of evidence' is valid in our Criminal Procedure Law. Although this principle provides for the possibility of revealing the material truth with all kinds of means of proof, the investigation and prosecution authorities have not been granted unlimited authority and arbitrariness in the process of collecting evidence. When applying search and seizure measures, judicial authorities must absolutely comply with the procedures for obtaining evidence through lawful means and methods stipulated in the Constitution and the Law. Only by protecting these boundaries can a free and secure state of law be created. In this context, in our study, the evidence prohibitions in search and seizure measures in a criminal trial in accordance with the principles of the rule of law were evaluated by taking into account the ECHR, the Constitution, the Criminal Procedure Code and other relevant laws and regulations.
