Polisin Zor ve Silah Kullanma Yetkisinde Sınırın Aşılması

Abstract

Toplumdaki refah ve kamu düzeninin bozulmaması güvenlik ihtiyacından kaynaklanmaktadır. Bu sebeple hukuk düzeni tarafından yasalar ile amaç ve sınırları belirlenmiş kolluk kavramı yaratılmıştır. Polisin yetkileri yasal düzenlemelerden gelmektedir. Polise verilen her türlü yetki kaynağını yasalardan almaktadır. Yasa koyucu polise verilen yetkileri düzenlediği gibi buna ilişkin sınırlarda hukuki denetimin nasıl yapılacağını da açıkça düzenlemiştir. Polise verilen zor ve silah kullanma yetkisinin şartlarının birinin bile yerine getirilmemesi durumunda hukuka aykırılık söz konusu olur. Çalışmamızda zor ve silah kullanma yetkisi ve bu yetkide sınırın aşılmasının hukuki boyutu, ilgili yasalar kapsamında detaylı şekilde incelenmiş; polisin kendisine verilen zor ve silah kullanma yetkisinde sınırı aşması durumunda cezai sorumluluğun yanı sıra idari ve hukuki sorumluluğunun da bulunduğu hususlarının üzerinde durulmuştur. The welfare in society and the non-disruption of public order are derived from the consumption of security. For this reason, a law enforcement structure has been established with the rules of legal order and defined goals and boundaries. The powers of the police consist of legal regulations. The various authority documents given to the police consist of laws. As well as regulating the powers granted to the legislating police, it has also been clearly regulated how to conduct legal supervision at the relevant borders. If even one of the conditions of the given police force and authorization to use weapons is not met, there will be a violation of the law. In our study, the authority to use force and weapons and the legal dimension of exceeding this authority limit were examined in detail within the scope of the relevant limits; the issues included in the administrative and legal structure, as well as criminal liability in case of exceeding the limit in the authority to use force and weapons given by the police, were emphasized.
