Küçüğün Kişisel Verilerinin İşlenmesine Rızası

Abstract

İçinde bulunduğumuz bilişim ve teknoloji çağında kişisel veriler, gündelik hayat içerisinde sıklıkla işlenmektedir. Bu durum, pek çok açıdan bireyin yaşamında kişisel verilerinin işlenmesi anlamını taşımakta ve sonuçlar doğurmaktadır. Söz konusu çocuklar ve onların kişisel verileri olduğunda özenli ve özellikli bir değerlendirme yapılmalıdır. Zira bilişim ve teknoloji çağına doğan çocukların korunmaları özel bir önem taşımaktadır. Kişisel verilerin işlenmesinin hukuka uygunluğundan bahsedebilmek için söz konusu işleme faaliyetinde bir hukuka uygunluk sebebi bulunmalıdır. Açık rıza, kişisel verilerin işlenmesinde sıklıkla kullanılan bir hukuka uygunluk sebebidir. Bu çalışmada küçüğün verilerinin işlenmesine rızanın kim tarafından, ne şekilde verileceği mevcut düzenlemeler ışığında Türk hukuku ve AB Hukuku bakımından karşılaştırmalı olarak incelenecektir.

In the information and technology age we are in, personal data are frequently processed in daily life. Since this situation means the processing of personal data in the life of the individual in many respects, its processing has consequences. When it comes to children and their data, a separate and specialised evaluation should be made. Because the protection of children born into the age of information and technology is of special importance. In order to talk about the lawfulness of the processing of personal data, there must be a reason for compliance with the law in the processing activity in question. Explicit consent is a ground of lawfulness frequently used in the processing of personal data. In our study, by who and how the consent to the processing of the data of the minor in question will be examined comparatively in terms of our law and EU law in the light of the current regulations.
