Uyuşturucu veya Uyarıcı Madde İmal veya Ticareti(TCK 188)

Abstract

Uyuşturucu veya uyarıcı maddelerin tarihi, insanlık kadar eskidir. Önceleri tıpta tedavi edici özelliklerinden faydalanılan bu maddelerin kullanımı zaman içinde kontrolsüz şekilde yaygınlaşmıştır. Endüstri ve kimya sanayinin gelişmesiyle birlikte bitkilerden elde edilen uyuşturucu veya uyarıcıların yerini çok tehlikeli ve hatta öldürücü olan sentetik ilaçlar almıştır. Tüm dünyada olduğu gibi ülkemizde de uyuşturucu veya uyarıcı maddelerin yasa dışı ticarete konu edilmesi yasal düzenlemelerle yasaklanmıştır. Çalışma konumuz kapsamında 5237 S. TCK m.188 hükmünde düzenlenen uyuşturucu veya uyarıcı madde imal ve ticareti suçu hem Yargıtay içtihatları hem de öğretideki muhtelif görüşler ışığında incelenmiştir.

The history of narcotic or stimulant substances dates back to the dawn of humanity. Initially, these substances were used in medicine for their therapeutic properties; however, over time, their use has spread uncontrollably. With the advancement of industry and the chemical sector, synthetic drugs—extremely dangerous and even lethal—have replaced naturally derived narcotic or stimulant substances. As in the rest of the world, the illicit trade of such substances is criminalized in our country as well. Within the scope of this study, the offense of manufacture and trafficking of narcotic or stimulant substances, regulated under Article 188 of the Turkish Penal Code No. 5237, is examined in light of the case law of the Court of Cassation and various scholarly opinions.
