Uzaktan Çalışmada İş Sağlığı ve Güvenliğinin Hukuki Boyutu

Abstract

Değişen ve gelişen dünyada, mevcut koşullar, iş hayatında esnek çalışma modellerinin uygulanmasını gerekli kılmıştır. Günümüzde, en yaygın esnek çalışma modellerinden biri de uzaktan çalışmadır. Uzaktan çalışma, en temel ifadeyle, işçinin işverene ait işyeri dışında iş görmesidir. Uzaktan çalışma modeli, uygulamada uzun zamandır var olmakla birlikte, son yıllarda COVID-19 küresel salgınında oldukça yaygınlaşmıştır. İşverenin işçiyi koruma ve gözetme borcu kapsamında iş sağlığı ve güvenliğini sağlama yükümlülüğü, uzaktan çalışmada da devam etmesine karşın, uzaktan çalışan işçi üzerindeki denetim gücü önemli ölçüde azalmaktadır. Bu çelişki, iş ilişkisinde birtakım hukuki sorunlara sebep olmaktadır. Bu çalışmanın amacı, uzaktan çalışmada iş sağlığı ve güvenliğine ilişkin sorunları tespit edip değerlendirmek ve temel haklar ile ilişkilendirerek görüş ve öneriler sunmaktır. Bu çalışmada, öncelikle "uzaktan çalışma" ve "iş sağlığı ve güvenliği" kavramları açıklanmıştır. Sonrasında, uzaktan çalışmada iş sağlığı ve güvenliğine ilişkin hususlar, hukuk perspektifiyle ele alınmıştır. Özellikle bu noktada, iş sözleşmesinin tarafları olan işçi ve işverenin karşılaştıkları ve karşılaşmaları muhtemel sorunların üzerinde durulmuştur. Bu sorunların temelinde yatan sebepler incelendikten sonra görüş ve öneriler sunulmuştur. Çalışma yürütülürken, literatür taraması yapılmış ve birtakım deneysel ve istatistiksel verilerden yararlanılmıştır.

In the changing and developing world, present conditions necessitate flexible working models to be implemented in professional life. Today, one of the most common flexible working models is remote working. Remote working, in the most basic term, is when the employee works outside the employer's premises. Even though remote working model has existed in practice for so long, it has become extremely widespread during the COVID-19 pandemic in recent years. Notwithstanding the employer's obligation to ensure occupational health and safety within the scope of the duty to care of the employee remains in remote working, his/her power of inspection over the remote working employee decreases considerably. This contradiction leads to some legal problems in the employment relationship. The aim of this study is to identify and examine the problems regarding occupational health and safety in remote working, and to offer opinions and solutions, correlating the issues with the fundamental rights. In this study, firstly, the concepts of "remote working" and "occupational health and safety" were explained. Then, the issues concerning occupational health and safety in remote working were discussed from the legal perspective. Especially at this point, the problems faced and likely to be faced by the employee and the employer who are the parties of the employment contract were emphasized. After the reasons that lie at the bottom of these problems were examined, the opinions and solutions were offered. As the study was being carried out, a literature review was conducted, and some empirical and statistical data were utilized.
