Uzaktan Çalışma

Abstract

Uzaktan çalışma konulu çalışmamızda öncelikle uzaktan çalışmanın tipik iş sözleşmesinden farkı ortaya konmaya çalışılmıştır. Özellikle uzaktan çalışmanın diğer sözleşmelerdeki temel farkı olan işyeri dışında iş görme irdelenmiş, teknolojik iletişim araçlarının bu çalışmadaki önemi ortaya çıkarılmıştır. Yine uzaktan çalışma işverenin fiili hâkimiyet alanı olan işyeri dışında bir çalışma olduğundan işverenden ayrı bir yerde çalışma nedeniyle oluşan farklılıkların iş ilişkisine etkisi incelenmiştir. Birinci bölümde uzaktan çalışmanın benzer atipik iş sözleşmelerinden farkları belirtilmiş, uzaktan çalışma sözleşmesinin unsurları ortaya konularak iş ilişkisindeki yeri, işverenin iş organizasyonunun işyeri olmadan da uygulayabilme imkanı vurgulanmıştır. İkinci bölümde ise önceki bölümde betimlenen uzaktan çalışma sözleşmenin kanunda düzenlenen şartları dâhilinde sözleşmenin oluşturulma koşulları belirtilmiş, sözleşmenin kurulması sonrası uzaktan çalışan ve çalıştıranın yükümlülükleri hem genel anlamda hem de kendine özgü yönleri üzerinden incelenmiş, üçüncü bölümde ise uzaktan çalışanın çalışma süresine etkisi, ara dinlenmeleri ve tatillerin bu çalışmada nasıl uygulanabileceği sorularına yanıt verilmeye çalışılmış, son bölümde ise uzaktan çalışmanın sona ermesinin hukuki sonuçları incelenmiştir.

İn our study working at home as a method of working remotely, it has been first triede to reveal the difference of working remotely from the typical employment contract. İn particular, working outside the workplace, which is the main difference of remote working from other contracts, has been examined and the imprtance of technological communication tools in this study has been revealed. Since working remotely is a work outside to workplace, which is the employer's actual control area, the effect of the differences arising from working in a different place from the employer on the business relationship has been examined. İn the first part, the differences of working remotely from similar atypical employment contracts have been specified and theelements of the remote work contract have been revealed and the place in thi employment relationship has provided the opportunity to be implemented without the workplace of the employer's work organization. İn the second part, the conditions fort he formation of the contract have been specified within the terms of the remote work contract regulated in law described in the previous part and after the establishment of the contract, the obligations of the remote employee ande the employer have been examined both in general terms and on their specific aspects. İn the third part, it has been triede to answer the questions of what the effects of remote employee on the working hours are, how rest breaks and holidays can be implemented in this study. İn the last part, the legal consequences of the termination of work have been examined.
