Türk Hukuku'na Göre Taşıyanın Konişmento İçeriğinden Sorumluluğu

Abstract

Çalışmamızda "Türk Hukuku'na Göre Taşıyanın Konşimento İçeriğinden Sorumluluğu" konusu son gelişme ve düzenlemeler de dikkate alınarak incelenmiştir. Taşıyanın sorumluluğunun kaynağını teşkil etmesi ve taşıyanın sorumluluğu konusunu açıklayabilmek için gerekli olması nedeniyle, çalışmamızda öncelikle konşimento konusu ayrıntılı bir şekilde ele alınmıştır. Bu anlamda çalışmanın birinci bölümünde genel olarak konşimento kavramı, düzenlenme şekli, türleri, içeriği, fonksiyonları ve navlun sözleşmesiyle olan ilişkisine değinilecektir. Çalışmamızın İkinci Bölümünde taşıyanın konşimento içeriğinden sorumluluğu incelenecektir. Konuya, Türk Ticaret Kanununda da düzenlenmiş konşimentonun karine özelliği incelenerek başlanacaktır. Sonrasında, taşıyanın eşyanın zıyaa, hasara uğraması veya geç teslim edilmesinden ileri gelen zararlardan sorumluluğu incelenecektir. Bu anlamda taşıyanın sorumluluğunun hukuki mahiyeti, şartları, sonuçları ve ispat yükünün kimde olduğu konularına değinilecektir. Taşıyanın sorumluluğu konusunda Türk Ticaret Kanunu hükümleri yanında konşimentonun sözleşme vasfı nedeniyle ilgili olduğu Türk Borçlar Kanununun ilgili hükümleri de tartışılacaktır. Deniz yoluyla taşımalarda önemli bir konu olduğundan taşıyanın konşimentoyu yanlış düzenlemesi nedeniyle doğacak sorumlulukları da incelenecektir. Son olarak, taşıyanın eşya taşıma işini yerine getirmede faydalandığı fiili taşıyanın sorumluluğu da işlenerek çalışma sonlandırılacaktır.

In this thesis, the issue of "carrier's liability of bill of lading's content According to Turkish Law" is examined by taking into consideration the latest developments and regulations. Since the carrier is the source of the responsibility of the carrier and it is necessary to explain the responsibility of the carrier, firstly, the subject of the discussion is discussed in detail. In this sense, in the first part of the study, the concept of a bill of lading, its form, types, contents, functions and its relationship with the contract of affreightment will be mentioned. In the second part of our study, the carrier's liability for the bill of lading's content will be examined. The subject will be started by examining the presumptive feature of the bill of lading also arranged in the Turkish Commercial Code. Then, the liability of the carrier's liability for loss resulting from loss of, damage to the goods and delay in delivery relating to the carriage of goods shall be examined. In this sense, the legal nature of the liability of the bearer, the conditions, results and the burden of proof will be addressed. In addition to the provisions of the Turkish Commercial Code, the relevant provisions of the Turkish Code of Obligations related to the nature of the contract will be discussed as well as the provisions of the Turkish Commercial Code. Since the transportation by sea is an important issue, the responsibilities of the carrier due to the wrong arrangement of the bill of lading will be examined. Finally, the work will be terminated by processing the liability of the actual carrier, which the carrier will use to carry out the goods transportation.
