Abstract
Bu çalışmada işverenin iş sözleşmesini işçinin ahlak ve iyi niyet kurallarına uymayan haller ve benzeri davranışları nedeniyle haklı nedenle feshi ele alınmıştır. Çalışma, üç bölümden oluşmaktadır. Birinci bölümde iş sözleşmesi ve tarafları açıklanmıştır. İş sözleşmesinin taraflara yüklediği borçlar ve işçinin bu borçlara aykırı davranışlarının hukuksal sonuçlarına değinilmiştir. İkinci bölümde İş Kanunu'nda düzenlenen işverenin iş sözleşmesini işçinin ahlak ve iyi niyet kurallarına uymayan haller ve benzeri davranışlarından kaynaklanan haklı fesih nedenleri, konu ile ilgili Yargıtay kararları da gösterilerek açıklanmıştır. Bunun yanında ilgili bölüme İş Kanunu'nda düzenlenmeyen ancak Türk Borçlar Kanunu'nda düzenlenen psikolojik taciz alt başlığı da eklenmiştir. Son bölümde ise işverence iş sözleşmesinin haklı nedenle fesih hakkının kullanılma koşullarına değinilmiştir. İşverenin iş sözleşmesini haklı nedenle fesih hakkının sınırlandırılması ve ispat yükü hususları tartışılmıştır. İşverenin iş sözleşmesini haklı nedenle feshinden doğan hukuksal sonuçlara değinilmiştir. İşveren tarafından yapılan haksız fesih ve hukuksal sonuçları açıklanmıştır.
This thesis analyses the rightful termination of the labor contract due to the breach of morality and good faith rules and similar behavior by the employer. This thesis consists of three parts. In the first part, the labor contract and its parties are explained. The obligations arising from the labor contract and legal consequences of the breach of obligations are mentioned. In the second part, rightful termination of the labor contract by the employer due to the breach of morality and good faith rules and similar behavior, which are regulated in Labor Code, is explained with the assist of the relevant Supreme Court decisions. In addition, psychological harassment, which is not regulated in Labor Code but regulated in Turkish Code of Obligations, has been added to the relevant section. In the last part, the conditions of using the right of rightful termination of the labor contract by the employer are mentioned. Delimitation of the employer's right to terminate the labor contract for the justified reason and the burden of proof are discussed. The legal consequences arising from the rightful termination of the labor contract by employer are mentioned. The unjust termination by the employer and legal consequences are explained.
