Abstract

O¨lu¨me bagˆlı tasarruflar 4721 sayılı Tu¨rk Medeni Kanunu'nun Miras Hukuku bas¸lıklı u¨c¸u¨ncu¨ kitabının Mirasc¸ılar bas¸lıklı birinci kısmının ikinci bo¨lu¨mu¨nde du¨zenlenmis¸, ancak o¨lu¨me bagˆlı tasarruf kavramı Tu¨rk Medeni Kanunu tarafından tanımlanmamıs¸tır. Buna kars¸ın s¸ekli^ ve maddi anlamda sınıflandırılan o¨lu¨me bagˆlı tasarruflar bu bo¨lu¨mde yer alan hu¨ku¨mler ile s¸u s¸ekilde tarif edilebilir; o¨lu¨me bagˆlı tasarruflar hu¨ku¨m ve sonuc¸larını, tasarruf sahibinin o¨lu¨mu¨ ile dogˆuran hukuki is¸lemlerdir. O¨lu¨me bagˆlı tasarruflar iki gruba ayrılmaktadır. Bunlar s¸ekli^ o¨lu¨me bagˆlı tasarruflar ve maddi o¨lu¨me bagˆlı tasarruflardır. Bu bagˆlamda, ilk anlamda o¨lu¨me bagˆlı tasarrufun bu¨ru¨nmesi gereken s¸ekli^ husus anlas¸ılırken ikinci anlamda bu s¸ekilde ortaya c¸ıkan o¨lu¨me bagˆlı tasarrufun anlamı ve amacı anlas¸ılmaktadır. Bu tezimizde o¨lu¨me bagˆlı tasarrufların iptali u¨zerinde durulacaktır. Bu bagˆlamda o¨lu¨me bagˆlı tasarrufların neler oldugˆu, bu hukuki is¸lemlerin nasıl iptal edilebilecegˆi ve yargılama su¨reci ac¸ıklanmaya c¸alıs¸ılacaktır.

Testamentary dispositions are regulated by the Turkish Civil Code (Law No. 4721) in the second section of the first chapter titled Inheritors of the third book titled Inheritance Law but the term testamentary disposition is not defined by the law. On the other hand, testamentary dispositions which are classified as formal and material can be described in this section as follows: testamentary dispositions take effect upon the death of the person making it. They are divided into two groups. These are formal testamentary dispositions and material testamentary dispositions. In this context, the former is to be understood as instruments used to make testamentary dispositions and the latter denotes the meaning and the purpose of a testamentary disposition. This thesis will focus on the annulment of testamentary dispositions. In this respect, we will try to explain what a testamentary disposition is, how this legal transaction can be annuled and how the courts proceed.
