2002 Atina Sözleşmesi Kapsamında Deniz Yolu ile Yolcu Taşıma Sözleşmelerinde Zorunlu Sorumluluk Sigortası

Abstract

6102 Sayılı Türk Ticaret Kanunu (TTK) 1247 vd. maddelerinde ele alınan Deniz Yolu ile Yolcu Taşıma Sözleşmeleri, Kanun'un Deniz Ticareti Sözleşmeleri kapsamında yer almaktadır. İlgili hükümlerin dayanağını 01/11/2002 tarihinde kabul edilmiş olan "Yolcuların ve Bagajların Deniz Yolu İle Taşınmasına İlişkin Atina Sözleşmesine Ait 2002 Protokolü" "(2002 Protokolü)" oluşturmakta olup, Protokol, 13/12/1974 tarihli "Yolcuların ve Bagajların Deniz Yolu İle Taşınması İlişkin Atina Sözleşmesi" " (1974 Atina Sözleşmesi)" hükümlerinde önemli değişiklikleri düzenlemektedir. Türkiye 19 Eylül 2019 Perşembe günü 30893 (Mükerrer) sayılı Resmi Gazetede yayınlanan 1580 sayılı karar ile 2002 Protokolü'nün 17. maddesi kapsamında Sözleşmeye taraf olma iradesini göstermiştir. Ancak 2020 Eylül ayı itibariyle hala tevdi belgesi düzenlenmemiş olup Sözleşme Milletlerarası Hukukta Türkiye Hakkında henüz yürürlükte değildir. Sözleşme'nin Türkiye hakkında yürürlük kazanması, katılma belgesinin tevdi makamına sunulmasından üç ay sonra gerçekleşecektir. 2019 yılının son aylarında kendini gösteren ve küresel bir krize dönüşen CoViD-19 Pandemisi uluslararası ilişkileri her ne kadar yavaşlatmış olsa da, kısa süre içerisinde Sözleşme'nin Türkiye hakkında yürürlük kazanacağı aşikardır. Çalışmamızda öncelikle deniz yolu ile yolcu taşıma sözleşmelerini Atina Sözleşmesi ve Türk Hukuku kapsamında ele alacak sonrasında bu sözleşmeler açısından Atina Sözleşmesi kapsamında "Deniz Yolu ile Yolcu Taşıma Sözleşmelerinde Zorunlu Sorumluluk Sigortası" üzerinde duracağız. Çalışmamızın içinde CoViD-19 Pandemisine Sözleşme ışığında kısaca değinmeye çalışacağız.

Contracts of carriage of passengers by sea, which are regulated in article 1247 and the following of the Turkish Commercial Code No: 6102, are located under the section of Maritime Commerce Contracts. The relating terms are based on the "Protocol of 2002 of the Athens Convention relating to the Carriage of Passengers and their Luggage by Sea" which was adapted on 01/11/2002 and the protocol regulates significant changes on the "Athens Convention relating to the Carriage of Passengers and their Luggage by Sea" which is dated 13/12/1974. Turkey declared it's will on becoming a party to the convention based on article 17 of the 2002 protocol, by the decree no: 1580 that was published on the official gazette dated 19th of September 2019 Thursday, numbered 30893. However the depository document is yet to be prepared as of September 2020, therefore the convention is not yet in force for Turkey as in the terms of International Law. The enforcement of the convention for Turkey will be eligible three months after the participation certificate is presented to the deposit authority. Even though the Pandemic Covid-19, which was surfaced during the late 2019 and caused a global crisis, has caused a major deceleration in terms of international relations, it is certain that the convention will be enforced for Turkey soon enough. In this study we will first examine the Contracts of carriage of passengers by sea in the context of Athens Convention and Turkish Law then we will discuss the "Compulsory Liability Insurances on the Contracts of carriage of passengers by sea, in the context of these contracts based on the Athens Convention. Finally we will try to examine the CoVID-19 Pandemic briefly in the light of the convention.
