Türk Sosyal Güvenlik Hukuku Kapsamında İş Kazası ve Meslek Hastalıkları Sigortası

Abstract

İş kazaları ve meslek hastalıkları geçmişten bu yana, gerek sosyal gerek ekonomik sonuçları dolayısıyla tüm dünyada olduğu gibi Türkiye'de de önemli bir problem olarak ehemmiyetini korumaktadır. Ülkemizin de dahil olduğu, istihdam için kırsal alandan kente doğru artan göçün yaşandığı gelişmekte olan ülkelerde eğitimin ve önlemlerin eksikliği sebebiyle iş kazası ve meslek hastalıkları sayısında hızlı bir artış yaşanmaktadır. Son yıllarda ülkemizde art arda yaşanan facialar sonucunda İş Kazası ve Meslek Hastalıklarını henüz gerçekleşmeden önlemeye yönelik eskisine göre daha çok tedbirler alınmaya çalışılsa da henüz gelişmiş ülkelerin seviyesinden çok uzak durumdayız. Her ne kadar İş kazalarının ve meslek hastalıklarının neredeyse tamamı İş Sağlığı ve Güvenliği mevzuatı çerçevesinde gerekli ve yeterli önlemler alınarak önlenebilir olsa da, önlenemediği durumlarda sosyal devlet ilkesi gereği Anayasal sosyal güvenlik hakkı kapsamında olan İş Kazası ve Meslek Hastalığı Sigortası kurum ve kuralları ile kazaya uğrayan ve yakınlarının mağduriyetinin giderilmesi açısından hukuki güvence sağlamaktadır. Bu çalışmada, Sosyal Güvenlik Hakkı kapsamında İş Kazası ve Meslek Hastalığı Sigortası; Sosyal güvenlik kavramından başlanarak ve n yargı kararlarıyla irdelenerek incelenmeye çalışılacaktır.
