Abstract
İş sözleşmesinin ayırıcı özelliği olan bağımlılık unsuru,işverenin yönetim hakkının temelini oluşturmaktadır.İşçi iş görme borcunu işverenin talimatlarına uygun, özenle ve sadakatle yerine getirmek; işveren de işçiyi gözetme borcu kapsamında, iş sağlığı ve güvenliği yükümlülüklerini yerine getirerek işçinin ruh ve beden sağlığını korumak zorundadır. Türkiye, işçi sağlığı ve iş güvenliğini geliştirmeyi amaç edinen uluslararası sözleşmeleri benimseyerek, 6331 sayılı İş Sağlığı ve Güvenliği Kanunu ile işverenin yükümlülüklerini düzenlemiştir. Bu kapsamda işçi de, iş sağlığı ve güvenliği ile ilgili alınan tüm tedbirlere ve işverenin bu yöndeki emir ve talimatlarına uymakla yükümlüdür. Aksi halde, işçinin kusuruyla yükümlülüklerini ihlal etmesinden dolayı iş kazası veya meslek hastalığı meydana geldiği durumda sözleşmeye aykırılık sebebiyle iş sözleşmesinin feshi söz konusu olabileceği gibi tazminat sorumluluğu da doğabilecektir.
Dependency of employee to employer as a distinctive feature of labour contract, bases on the management right of the employer at work. Employee has to perform business obligation carefully and loyally according to the instructions of employer while employer has to protect employee's mental and body health by complying with occupational safety and health obligations as part of obligation of protecting employee. Turkey has regulated the obligations of employer within the Occupational Health and Safety Law Number 6331 by adopting international conventions for protecting health and safety at work. In this context employee is obligated to observe all conducts which are related to occupational health and safety and also employer's orders and instructions in this aspect. Otherwise, there will be both labour contract termination and compensation responsibility when occupational accident or illness occur due to employee's infringing obligations, which derive from labour contract.
