Arsa Payı Karşılığı İnşaat Sözleşmelerinde Müteahhidin Temerrütten Sorumluluğu

Abstract

Arsa payı karşılığı inşaat sözleşmeleri karma tipli atipik sözleşmelerdir. Yapısında eser sözleşmesi ve taşınmaz satış sözleşmesi unsurlarını barındırır. Ancak kendine özgü özellik taşıdığından yapısını oluşturan bu sözleşme türleri doğrudan uygulanamamaktadır. Kanunda düzenlenmemiş olan, günlük hayattaki ihtiyaçtan doğmuş ve gün geçtikçe kullanılması yaygınlaşan bu sözleşmenin uygulanmasında ortaya çıkan sözleşmesel eksiklikler, ihlaller ve bunların çözümüne ilişkin hukuksal metotlar çalışmamızda irdelenmiştir. Tezimizde inşaat hukukunda önemli yeri olan arsa payı karşılığı inşaat sözleşmelerinde müteahhidin temerrüdü ve bundan kaynaklı sözleşmenin son bulması durumları incelenmiştir. Bunu incelerken sözleşmenin yapısı, birincil unsurları, şekli, tarafları ve taraflarının yükümlülükleri, müteahhidin temerrüde düşme durumu ile temerrüt sonucunda arsa sahibinin kullanabileceği hakları, üçüncü kişilerin sözleşmeden dönülmesi durumunda sahip olduğu haklar doktrin görüşleri ve yargı kararlarıyla birlikte açıklanmıştır.

The construction contracts in return for land share are mixed modecontracts. The structure is created by the agreement for work and the immovable sales contract. But because it owns the specific details which creates its's structure. These kinds of contracts can not be implemented. The implementation of this contract, which is specified by law, occurs by needs of Daily life and is used more often day by day. The contractual deficiencies, violations and the legal methods regarding the correction have been scrutinized. In our thesis, the construction contract in return for land share, which plays an important role in construction law, the default of the contracting party vendor and the termination of the consequential contract has been analyzed. While analyzing the content of the contract,the primary elements, the feature, the parties and their responsibilities and also the case of the vendor's default and the following rights of the landloard, the rights of the third parties in case of the contract's termination, their doctrine remarks and jurisdictions have been analyzed.
