Alman Sosyal Ağlarda Hukuk Uygulamasının İyileştirilmesi Hakkında Kanuna İlişkin Değerlendirme

Abstract

With the development of technology, people’s methods and fields of using internet have both improved and changed. Today, social media networks are used as a means of getting news, notifying and communicating. Parallel to this, it was necessary to establish a legal framework in order to keep up with the rapidly developing technological laws and to find solutions to the problems in order to educate technologists during this time. One of the countries that responded to this requirement was Germany. This is not surprising given that it is one of the first countries to use the internet and the development of the legal system is taken into account. In addition to many legal regulations on the subject, the Law on Right to Claims and Sanctions (Law for the Improvement of Law Enforcement in Social Networks) was finally adopted by the German Social Network on September 1, 2017 and entered into force on 1 January 2018. Although the law foresees sanctions against hate crimes, many crimes from the German Criminal Code have been included (which crimes are defined as illegal content will be addressed in detail below). This article examines the articles one by one on the basis of the purpose served by the regulation of the new law, which consists of a total of six articles.

Teknolojinin gelişmesiyle birlikte insanların interneti kullanım yöntemleri ve alanlarıhem gelişmiş ve hem de değişmiştir. Günümüzde haber alma, haber verme ve iletişim aracıolarak sosyal medya ağları kullanılmaktadır. Buna paralel olarak, hızla gelişen teknolojiyehukukun ayak uydurması ve bu zaman sürecinde teknolojiye yetişmesi, bu bağlamda sorunlaraçözüm arayarak kişilerin haklarını savunacağı bir yasal düzlemin oluşturulması gerekmiştir.Bu gerekliliğe cevap veren ülkelerden biri de Almanya olmuştur. Bu durum interneti ilk kullananülkelerden biri olması ve hukuk sisteminin gelişmişliği göz önüne alındığında şaşırtıcı değildir.Konuya ilişkin birçok hukuki düzenlemenin yanında son olarak 1 Eylül 2017’de AlmanSosyal Ağlarda Hak Talepleri ve Yaptırımları Kanunu (Sosyal Ağlarda Yasa Uygulamasınınİyileştirmesi Kanunu)*1 kabul edilmiş ve 1 Ocak 2018’de yürürlüğe girmiştir.*2 Kanun, dahaçok nefret suçlarına karşı bir yaptırım öngörmüş olsa da Alman Ceza Kanununda yer alanbirçok suça (aşağıda detaylıca hangi suçların yasadışı içerik olarak tanımlandığı ele alınacaktır)da yer verilmiştir. Bu makalede toplam altı maddeden oluşan yeni kanunun düzenlemesininhizmet ettiği amaç esas alınarak maddeler tek tek incelenmektedir.
