Ticaret Gemilerinden Kaynaklanan Petrol Kirliliğinin Hukuki Sonuçları

Abstract

Ticaret hayatının vazgeçilmez unsurları kara yolu, hava yolu ve deniz yolu taşımacılığı olup, deniz yolu taşımacılığı diğer taşıma metotlarına nazaran daha ucuz ve konforlu olmasından dolayı tercih edilmektedir. Tek seferde büyük kütlelerde ki araçların güvenli bir şekilde taşınması deniz yolu taşımacılığını ön plana çıkaran sebeplerden biri olmuştur. Sanayileşmenin büyümesiyle ortaya çıkan ticaret trafiği çevreyi olumsuz yönde etkilemektedir. Turizm, ulaşım, beslenme, iyot, magnezyum ve oksijen üretimi gibi daha birçok konuda denizlerin temiz bir şekilde korunmasının önemi göz ardı edilmemelidir. Ayrıca, denizlerde oluşan kirlilik, özellikle petrol kirliliği, ekosistemde ki dengeleri bozmaktadır. Eğer önlem alınmazsa, besin zincirinde ki bir halkanın eksilmesi tüm canlı varlıkların zararına sonuçlar doğurabilecektir. Çevre kirliliğinin bir alt türü olan deniz kirliliğinin ortaya çıkardığı bu hayati önemdeki etkileriyle birlikte ortaya bir takım hukuki sonuçlarda çıkmaktadır. Öyle ki, petrol kirliliğine sebep olan ticaret gemilerinin hukuki olarak sorumlu olup olmadıkları, eğer sorumlu iseler bu sorumluluğun kime ait olduğu, her hangi bir yaptırıma maruz kalıp kalamayacakları gibi sorunlar gündeme gelmektedir. Çalışmamızda, bu sorunlara çözüm aranmaya çalışılmış olup gerek ulusal gerekse uluslararası anlamda sonuçlar elde edilmek istenmiştir.

The most irreplaceable parts of trade are air route, motorways and sea route, yet sea route is preferred more than the two since it is more comfortable and cheaper than the other options. One of the reasons that makes sea routes outstanding is transporting goods in large masses at once safely. Trade traffic, which emerges with the growth of the industrialization, affects the environment in a negative way. The importance of protecting the seas in terms of tourism, transportation, nutrition, iodine magnesium and oxygen production should not be ignored. In addition, pollution in seas, especially oil spill pollution, disrupts the balance in the ecosystem. If no measures are taken, the loss of one ring in the food chain may result in the harm of all living things. Marine pollution, a subcategory of environmental pollution, comes out in a number of legal consequences in addition to aforementioned vital effects. Therefore, the issues emerge as whether the vessels causing the oil spill pollution are legally responsible and thus if the responsibilities depend on who owns this responsibility, are they subject to a sanction, and what kind of sanctions will they be exposed to? In our work, we have tried to find answers to these questions and show some results both nationally and internationally.
