Abstract
El yazılı vasiyetname, 4721 sayılı Türk Medeni Kanunu’nda resmi vasiyetname ve sözlü vasiyetname ile düzenlenmiş üç tür vasi- yetnameden biridir. Kanun’un 538. maddesinde el yazılı vasiyetname şekil şartları da belirtilmek suretiyle düzenlenmektedir. Buna göre el yazılı vasiyetnamenin yapıldığı yıl, ay ve gün gösterilerek başından sonuna kadar mirasbırakanın el yazısıyla yazılmış ve imzalanmış ol- ması zorunludur. İsviçre Federal Mahkemesi’nin incelemeye konu kararında el yazılı vasiyetnamede imzanın vasiyetnamedeki yeri ve özellikle imzanın vasiyetnamenin içine konulduğu zarfın üzerine atıl- mış olması tartışma konusudur. Bu nedenle gerek doktrin gerek yar- gı kararlarında tartışılan bu konuya odaklanılmaktadır.
Holographic will is one of the three types of will reg- ulated in Turkish Civil Code No: 4721 with official will and oral will. Article 538 of the Civil Code regulates the holographic will by speci- fying some formal requirements. Accordingly, the holographic will must be written and signed in the hand writing of the testator from the beginning to the end, indicating the year, month and day it was made. In the decision under review by the Swiss Federal Court, the placement of the signature in the holographic will and, in particular, the fact that the signature is placed on the envelope containing the will, is a matter of debate. Therefore, this issue, which is discussed in both doctrine and judicial decisions, is being focused on.
